British Columbia’s new Commercial Liens Act (the “CLA”), effective June 30, 2025, simplifies, modernizes and consolidates liens that secure payment on repaired, stored, and transported goods, replacing the Repairers Lien Act, Warehouse Lien Act, and Livestock Lien Act.
The CLA establishes a single, unified statutory regime for a lien on goods for services performed in relation to those goods, securing either the contractually agreed-upon price or the market value of the services rendered.
In addition, the Commercial Liens Act will help streamline and enforce liens by adopting similar processes and alignment with the British Columbia Personal Property Security Act.
What our customers need to know:
- Effective June 30, 2025, all active repairers’ liens, storers’ liens and carriers’ liens registered in British Columbia will be automatically changed to commercial liens.
- Changes within ESC’s platform or API will be made automatically on your behalf.
- Any existing repairers’ lien(s) and storers’ lien(s) may be renewed, amended or discharged as a commercial lien under the new Act.
